Terms of Service

1. Definitions

• "Platform" — refers to the BraineetyLM website, mobile applications, and all associated services.
• "User" — any individual who accesses or uses the Platform, including students, teachers, and institute administrators.
• "Content" — all text, graphics, audio, video, and data made available on the Platform.
• "Institute" — any school, coaching center, or educational organization that subscribes to BraineetyLM Enterprise.

2. Use of Service

BraineetyLM provides AI-powered educational assistance, including but not limited to doubt solving, homework help, adaptive classroom experiences, quiz generation, and teacher analytics dashboards. You agree to use the Platform only for lawful, non-commercial educational purposes unless explicitly authorized under a separate Enterprise agreement.

You must not use the Platform to generate, store, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. We reserve the right to suspend access for any user who violates this provision.

3. User Accounts

To access certain features, you must register for an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• Providing accurate, current, and complete information during registration.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We are not liable for any loss or damage arising from your failure to maintain secure credentials.

4. Intellectual Property

All content, branding, technology, software, and materials on the Platform are the exclusive property of BraineetyLM or its licensors. This includes but is not limited to the AI engine, curriculum alignment engine, analytics dashboards, UI/UX design, and all proprietary algorithms.

You may not copy, reproduce, modify, distribute, transmit, display, or create derivative works from any part of the Platform without prior written consent from BraineetyLM.

5. Acceptable Use

You agree NOT to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any portion of the Platform or its systems.
• Interfere with, disrupt, or overload the Platform's infrastructure.
• Use automated means (bots, scrapers) to access or extract data without permission.
• Impersonate any person or entity, or falsely represent your affiliation.
• Upload or transmit any malware, viruses, or harmful code.
• Reverse-engineer, decompile, or attempt to extract the source code of the Platform.

6. Service Availability

We strive to maintain continuous availability of the Platform. However, we do not guarantee uninterrupted access. We may temporarily suspend or modify services for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of major changes where feasible.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BraineetyLM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of educational opportunity, arising out of or related to your use of the Platform.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or ₹1,000 (one thousand Indian Rupees), whichever is greater.

8. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, all provisions of these Terms which by their nature should survive — including intellectual property clauses, limitation of liability, and indemnification — shall remain in effect.

9. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify users of material changes via email or an in-platform notification at least 14 days before the changes take effect.

Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not agree with the changes, you must discontinue use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless BraineetyLM, its founders, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
